Terms of Service – All In Cycles Mesquite Bikes

These Terms of Service ("Agreement") govern the use of the bike rental, fitting services, merchandise sales, and other offerings provided by Mesquite Bikes ("Company"), a bike rental and service provider based in Mesquite, Clark County, Nevada. By accessing our website or using our services, you agree to be bound by these terms and conditions. If you do not agree with these terms, please refrain from using our website or services.

1. Bike Rental:

• All bike rentals are subject to availability and confirmation by Mesquite Bikes.
• Rental rates and rental periods are specified on our website or provided at our shop premises.
• A valid identification and security deposit may be required before renting a bike.
• Rental period extensions should be requested in advance and are subject to availability and additional charges.
• The renter agrees to use the rented bike responsibly and in accordance with applicable laws and regulations.

2. Bike Fitting Services:

• Mesquite Bikes provides professional bike fitting services to ensure a comfortable and safe riding experience.
• Bike fitting services should be scheduled in advance and will be performed at our shop premises.

3. Free Maintenance:

• Customers who purchase a bike from Mesquite Bikes are eligible for two years of free maintenance services.
• Free maintenance services exclude the cost of parts, which will be charged separately.
• The customer must present proof of purchase to get off on free maintenance services.

4. Roadside Assistance and Pick-up/Delivery Services:

• Mesquite Bikes offers roadside assistance for customers facing technical issues with their rented bikes.
• Roadside assistance services may be subject to additional charges depending on the nature and location of the service.
• We provide pick-up and delivery services for customers unable to bring their rented bikes to our shop.
• A fee of $20 will be charged each way for pick-up and delivery services.

5. Limitations of Liability:

• Mesquite Bikes shall not be liable for any personal injury, property damage, or other loss arising out of or in connection with the use of our rental bikes or services, except where prohibited by law.
• The renter assumes all risks associated with the use of the rented bike and releases Mesquite Bikes from any liability for any such incidents or accidents.
• Mesquite Bikes shall not be responsible for any costs associated with repairs or replacements of parts that are not covered under warranty.

6. Intellectual Property:

• All content, trademarks, logos, and intellectual property on our website and in our shop are protected and owned by Mesquite Bikes.
• Users are prohibited from using, reproducing, or modifying any intellectual property belonging to Mesquite Bikes without prior written permission.

7. Governing Law and Jurisdiction:

• These Terms of Service shall be governed by and construed in accordance with the laws of the State of Nevada, specifically Clark County.
• Any legal actions or proceedings arising out of or relating to these terms shall be filed in the courts of Clark County, Nevada.

8. Modifications:

• We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time.
• Any changes will be effective immediately upon posting the revised terms on our website.

9. Severability:

If any provision of these Terms of Service is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms of Service unenforceable or invalid as a whole. Instead, the unenforceable or invalid provision shall be amended or replaced with a valid and enforceable provision that most closely reflects the original intent of the provision.

10. Entire Agreement:

These Terms of Service constitute the entire agreement between Mesquite Bikes and the user, superseding any prior agreements or understandings, whether oral or written, relating to the subject matter herein.
